U.S. Attorney Investigates Montgomery County Police Disability Pay

The Federal U.S. Attorney’s office is investigating 2 former assistant chiefs of the Montgomery County Police Department, John A. King and William C. O’Toole for the disability pay they both recieve.

King is the current Gaithersburg Chief of Police, as of 2007, and had served for the Montgomery County Police Department for over 25 years. He had recently resigned from his position as assistant chief for Montgomery County, to take his current position in the Gaithersburg Police Department. O’Toole also served as an assistant chief for over 20 years, and is currently the executive director of the Northern Virginia Criminal Justice Training Academy. Both King and O’Toole continue to receive disability retirement pay, despite the fact that they are still somehow able to hold jobs.

The U.S. attoreny had issued a federal grand jury subpoena on October 24th for records regarding their medical history, insurance claims, the city’s hiring process, salary information, and tax information, and other related documents.

Both parties have complied with the subpoenas, however the details of the investigation are being kept under wraps, and full details aren’t likely to be released until after everything has been settled.

    John King, Chief of the Gaithersburg Maryland Police Department, is the brother of George King. George King was the owner of the infamous, now defunct, Frank’s Towing of Arlington County Virginia. In 2005, Chief King’s brother was arrested and charged with towing and tax abuses.

    Everyone knows that Montgomery cops think they are above the law, have you ever had an encounter with them as a victim of crime. They act like you are wasting their valuable donut time. I hope they fry these two along with the dozens of other cops who are doing the same, collecting disability while able to work other jobs.

    Didn’t follow the complete investigation and the eventually dismissal of charges, but the little I remember about this story, I recall that ….

    The disability pay was something negotiated by the Police Union — part of the contract, which, in fact, allows people to collect disability and continue to be employed in some other capacity that does not conflict or adversely affect your disability….

    So what’s the problem here?

    I personally know people who are on Disability insurance, and the restrictions are tight, insofar as what you receive is based on certain conditions, like not being able to work beyond 25 hrs/wk, for example ….

    which really doesn’t make much sense when you look at it more closely….
    it’s like the government will recognize your disability—as long as you don’t break the rules required of you to follow, — i.e., you CANNOT work OVER so many hours per week, at essentially a minimum wage category….

    How does that make any sense?

    If we want to help people with disabilities lead productive lives and encourage them to engage socially and economically with the rest of us,i.e., society, then why do we penalize the skills and gifts they have to offer, by placing these foolish rules and conditions around how much and they can earn — a pittance? —

    Disability benefits (money) is based on a faulty formula, using questionable mathematics and social values to arrive at conclusions that are NOT beneficial to MOST of those receiving benefits . . .and . . . and lots of other things, that we, through the Program, are NOT allowed to do or accomplish or something that may help the disabled individual integrate more fully with the rest of society —

    I have no problem with that.
    If I had a powerful union behind me that offered an attractive package, I would take it, like that!

    What’s the problem here?
